Terms of Service

These Terms of Service ("Terms") govern your access to and use of BreakRoomHQ (the "Service"), operated by BreakRoomHQ ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BreakRoomHQ is a platform for content teams to plan posting, view per-creator analytics, track consistency, and calculate creator earnings across short-form video platforms including TikTok and Instagram. Features and functionality may change over time.

2. Accounts and eligibility

• Accounts are provisioned and authorized by a team administrator. The Service does not offer open or public sign-up.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Notify your administrator immediately if you suspect unauthorized use.
• You must be old enough to form a binding contract in your jurisdiction to use the Service.

3. Acceptable use

You agree not to:

• Access the Service without authorization, or attempt to access another team's data.
• Reverse engineer, disrupt, overload, or interfere with the Service or its security.
• Use the Service for any unlawful purpose or in violation of any third-party platform's terms.
• Misrepresent the authorship or performance of content in order to affect earnings calculations.

4. Third-party platforms

The Service integrates with third-party platforms, including TikTok and Instagram. Your use of those platforms is governed by their own terms and policies, including TikTok's Terms of Service. We are not responsible for third-party platforms, and we may lose access to their data if their terms or APIs change. You are responsible for complying with the terms of any account you connect.

5. Earnings figures

BreakRoomHQ calculates and displays earnings figures based on the pay rules your team configures and the performance data available to it. These figures are provided for your team's internal tracking and accounting only. The Service does not process payments or transfer money, and figures shown are not a guarantee of payment. Actual payment is handled by your team outside the Service.

6. Intellectual property

The Service, including its software, design, and content (excluding your own data and content), is owned by BreakRoomHQ and protected by applicable laws. You retain ownership of the content and data you provide. You grant us a limited license to store and process that data solely to operate the Service for you.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that data retrieved from third-party platforms will be complete or accurate.

8. Limitation of liability

To the maximum extent permitted by law, BreakRoomHQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits arising from your use of the Service.

9. Termination

Your team administrator may revoke your access at any time. We may suspend or terminate access to the Service if these Terms are violated or to protect the Service. You may stop using the Service at any time.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
